Welcome to Ensemble By Monika! These Terms of Service (“Terms”) constitute a binding agreement between you (“you” or “your”) and Ensemble, Inc. (“we,” “our,” or “us”), governing your use of our website located at ensemblebymonika.com (the “Site”), as well as any content, features, or services provided through the Site and related platforms (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to comply with these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.
The Services are only available to individuals who are 18 years or older and capable of entering into legally binding agreements. By using the Services, you confirm that you meet these requirements. If you do not, you are prohibited from accessing or using the Services.

Ensemble assumes no responsibility or liability for the actions, omissions, or products/services of other users of the platform. Any transactions or interactions between users are at their discretion and responsibility.
Ensemble reserves the right to amend these Terms at any time in its sole discretion. Modifications will take effect upon being posted on the Site. Your continued use of the Services following any changes indicates your acceptance of the updated Terms. Please review these Terms periodically to stay informed of any updates. If you do not agree with any changes, discontinue use of the Services immediately.
Except as provided in specific circumstances detailed below, disputes will be resolved through binding, individual arbitration. By using the Services, you waive your right to participate in class action lawsuits or class-wide arbitration. You also waive your right to a trial by jury.
The Services are operated from the United States and are not intended to subject Ensemble to jurisdiction outside of this region. Users are responsible for ensuring their use of the Services complies with all applicable laws in their respective locations. We may restrict access to the Services at any time for any person, geographic area, or jurisdiction.
Item(s): Products listed for use or purchase on the platform, including apparel, accessories, and other related items.
Lender: A user who lists Items for rental on the platform.
Listing: A posted offering by a Lender of Items available for rent.
Renter: A user seeking to rent Items through the platform.
Platform: Ensemble’s system for facilitating rentals and other related functionalities.
Ensemble specializes in renting and selling apparel, accessories, and other related products. Our Services allow users to create accounts and participate in renting or purchasing Items. Registered users (“Account Holders”) may act as Renters or Lenders. To list Items as a Lender, you must own or have the legal right to rent out those Items.
We reserve the right to modify or discontinue Services at any time without notice. This includes adjustments to product pricing, promotions, and rental terms. We are not liable to you or any third party for changes, suspensions, or discontinuation of Services.
When you place a rental order for a Product, you authorize Ensemble to charge your payment card or other payment method for the Rental Fee. It is your responsibility to ensure your Payment Method is valid and up-to-date. You must provide accurate billing and contact information to Ensemble and promptly notify us of any updates. Ensemble will charge your Payment Method the Rental Fee immediately upon placing your rental order. Reserving a Product through our Services constitutes a rental order, regardless of how far in advance the reservation is made.
At the time of your rental order, you also authorize Ensemble to charge your Payment Method up to the Retail Value of the Product as indicated on the Service, plus applicable taxes. However, Ensemble will only charge an amount exceeding the Rental Fee under specific circumstances, such as in the case of damage, late returns, or unfulfilled terms.
A deposit may be required at the time of booking or renting certain Products. The amount of the deposit will be specified in your order confirmation. The deposit is meant to cover any potential damages, late returns, or non-fulfillment of rental terms. The deposit will be fully refunded upon the return of the item(s) in satisfactory condition, minus any applicable charges for damages, late fees, or other applicable costs. If the item(s) are returned in unsatisfactory condition or the terms of the rental are violated, the deposit will be used to cover the damages, with the remaining balance (if any) refunded to the original payment method.
After the successful return of your rental item, 70% of your deposit will be refunded within 24 to 48 hours, following a quality inspection and deduction of any applicable charges, if necessary.
Rental Fees exclude all applicable taxes, duties, fees, and other assessments, which you are responsible for paying directly or reimbursing Ensemble if we cover them on your behalf. Product availability, pricing, and terms may change without notice. Ensemble reserves the right to limit or discontinue services, impose conditions on promotions, restrict user access to payments, or refuse services at any time without liability. You represent and warrant that:
Ensemble accepts payments via credit/debit cards, PayPal, and other available methods. By providing your payment information, you authorize Ensemble to charge your Payment Method for rental orders and associated fees. If recurring payments are set up, these payments will be processed according to the terms specified during registration.
Ensemble grants you a revocable, non-transferable, nonexclusive, limited license to access and use the Services in accordance with these Terms. All other rights are reserved by Ensemble.
We do not accept unsolicited suggestions or ideas. Any feedback, suggestions, or other information you provide to Ensemble will be treated as non-proprietary and non-confidential. By submitting any content, you grant Ensemble full ownership rights to use, reproduce, modify, adapt, publish, or distribute the content in any form, including for commercial purposes, without any obligation to compensate you.
You represent that you own or control the rights to the Submission and that it does not contain harmful elements such as software viruses or spam. Misrepresentation, such as providing false email addresses or impersonating others, is prohibited. You agree to indemnify Ensemble for any claims or damages related to your Submission.
You agree to use the Services lawfully and respectfully. Prohibited activities include, but are not limited to:
Ensemble reserves the right to take appropriate actions, including disclosing information to authorities or terminating access for violations.
All content and technology on the Services are the property of Ensemble and its licensors, protected by intellectual property laws. Using our Services does not grant you ownership of any intellectual property. Any unauthorized use may result in legal action.
Ratings and reviews are considered User Submissions and are subject to these Terms. Ensemble reserves the right to modify or remove any reviews at its discretion. Reviews do not represent the views of Ensemble, and we assume no liability for their content.

You can only return products if you have received the wrong or defective product. (Photos and Opening Video are required.)
We have a 3-day exchange policy, which means you have 3 days after receiving your item to request an exchange.
Please note that we only offer exchanges for items of the same or higher value.
To be eligible for a return or an exchange, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
Please note, the return article will need to be shipped back to us by the customer.
We have to receive the package within 14 days of delivery.
To start an exchange, please contact our team within 3 days of delivery with the following information:

Specify the Reason for Exchange and in case of a defective or incorrect product, please send us an image of the item.
If your exchange is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package.
You can always contact us for any return questions at ensemblecouture@gmail.com from Monday to Saturday, between 10:30 AM to 6:30 PM. We will look into the issue and respond accordingly.
We will not exchange/return any item that we were not notified about.
Pre-Order Articles cannot be returned or exchanged.
Made-to-Order/Stitched Articles cannot be returned or exchanged.
We will not exchange/return any custom order.
There will be only one exchange.
There will be no return/exchange on sale items.
No guarantee or warranty on fabrics.
Custom-made items and sourced articles cannot be returned or exchanged.
To ensure the successful delivery of your order, please be available to receive it at the scheduled time. We are not responsible for any issues that may arise if you are not present to accept the delivery. If you're unable to be home, we recommend making alternative arrangements to receive your order.
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can exchange it without any delay.
We offer a 100% refund if you have received a damaged product. (Opening Video of the parcel is mandatory to claim this.)
Refunds will be processed within 3-5 business days.
We reserve the right to refuse or cancel any order for reasons such as incorrect pricing, out-of-stock items, or increased shipping costs/import duties.
Cancellations apply to both paid and processed orders.
Customers will be informed of cancellations, and refunds will be issued accordingly.
We possess the authority to refuse or terminate any order for reasons such as incorrect pricing, unavailability of items, or escalated shipping costs/import duties.

It is important to note that an order can only be canceled within the first 24 hours of its placement. After the order has been processed, we are unable to entertain any cancellation requests.
As per our standard business practices, Ensemble reserves the right to cancel an order and issue a full refund to the customer, provided the order has not been approved or processed by us.
In instances where there is a delay in collection or delivery of the product from the brand or designer, Ensemble will not be able to cancel the order. However, store credits can be applied towards the cancellation.
We can ship to virtually any address in the US.
When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.
Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

This Rental Agreement ("Agreement") is made between Ensemble ("Lessor") and the individual or entity renting items from us ("Lessee"). By completing the rental process and confirming your order, you agree to abide by the terms set forth in this Agreement.
The Lessor agrees to rent the items selected by the Lessee as detailed in the order confirmation. Once the order is completed, an order confirmation will be provided to the Lessee, listing the rental items along with their associated costs.
The rental period will begin on the date the rented item(s) are delivered to the Lessee. The rental period will end on the specified return date, which will be communicated to the Lessee in the order confirmation.
The Lessee is responsible for properly caring for and maintaining the rented items during the rental period, ensuring that they remain in their original condition. The Lessee must return the items in their original, undamaged condition, free from excessive wear, and without alterations. In case of any issues or defects with the rented items upon receipt, the Lessee must notify Ensemble promptly.
Items must be returned in their original condition, including any attached tags and packaging. The Lessee is responsible for securely packaging the items when returning them to prevent any damage during transit.
If any items are returned damaged, stained, or excessively worn, the Lessee will incur additional charges based on the extent of the damage. Minor damage will result in a $50 charge per item, moderate damage will incur a $75 charge per item, and major damage or replacement will incur the full cost of the item, based on its retail price .
Items must be returned by the specified due date as mentioned in the order confirmation. A late fee of $25 per day will be charged for each overdue item if they are returned after the due date.
A refundable deposit may be required at the time of order confirmation. The deposit amount will be specified in the order confirmation and is held to cover any potential damage, late return fees, or other costs associated with the rental items. The deposit will be refunded after the items are returned in satisfactory condition, subject to any applicable deductions for damages or late fees.

All rental fees and applicable charges must be paid in full at the time of order confirmation. Refunds will be processed to the original payment method after the item has been returned in satisfactory condition.
Some items, such as clearance or sale items, are final sales and are non-refundable. Returns will only be accepted if the item is in its original condition and packaging, without alterations. If there is a sizing or quality issue, the Lessee must notify Ensemble’s customer service team within 24 hours of delivery. The item must be returned within 24 hours to qualify for a refund. Refunds will be processed to the original payment method.
By checking the box at checkout, the Lessee acknowledges that they have read, understood, and agree to be bound by the terms outlined in this Agreement.
